The appellant, Honourable Bewaji, by an originating summons sought certain questions for determination at the Federal High Court, Abuja. The questions are inter alia whether having regard to the provisions of the Constitution, the 1st respondent, President Olusegun Obasanjo could impose a consumption tax on the federation without the consent of the National Assembly, first had and obtained and whether having regards to the provision of section 162 of the 1999 Constitution, the petroleum tax imposed by the respondent could be legally imposed not being a receipt arising from the operation of a law made by the National Assembly
