The claimant sued the defendant at the High Court of Lagos State on the allegation
that it carried out certain works for the defendant between the period of January
2013 to December 2015 amounting to the sum of US$338,000.00 (Three Hundred
and Thirty Eight Thousand United States Dollars) but was not paid by the defendant
after repeated demands were made by the claimant. The claimant also filed a
Motion for summary judgment.
The originating processes as well as the motion for summary judgment were
served on the defendant and proof of service filed in court but the defendant failed
to enter appearance and was not represented. Hearing Notice was issued and
served on the defendant yet it failed to enter appearance or file its defence. The
court therefore, set the matter down for trial.
The claimant opened its case and tendered exhibits. The court adjourned the suit
for cross examination. On the adjourned date, the defendant failed to appear in
court or be represented. The court consequently closed the defendant’s case and
ordered the claimant to file its final written address.
One of the issues raised for determination by the claimant was whether or not the
defendant is indebted to the claimant in the sum of US$338,000.00 (Three Hundred
and Thirty Eight Thousand United States Dollars) being the total sum of money
owed the claimant by the defendant for the various services rendered to the defendants between the year 2013 to 2015.
