The claimant granted a facility ofN50,000,000.00 (Fifty Million Naira) to the
defendants. The parties agreed that the facility was to attract 17% interest rate
per annum. The defendants defaulted in making repayment and the claimant
instituted an action at the High Court of Lagos State to recover the principal sum
and accrued interest. The matter was referred to the Case Management Conference.
At the end of proceedings, the Case Management judge gave part judgment in
favour of the claimant to the tune ofN50,000,000.00 (Fifty Million Naira) being the
principal facility sum while the other claims were forwarded for trial.
The other claims included accrued interest ofN54,443,295.06 (Fifty Four Million
Four Hundred and Forty Three Thousand Two Hundred and Ninety Five Naira Six
Kobo), special damages amounting to the sum ofN5,692,164.75 (Five Million Six
Hundred and Ninety Two Thousand One Hundred and Sixty Four Naira Seventy
Five Kobo) pre-judgment and post-judgment interest and the cost of the action.
The defendants who had participated in all the proceedings at the Case Management
Conference failed to defend the matter after it went to trial in spite of the fact that
hearing notices were served on them.
