The appellant was up till the time of his dismissal was a public officer in the employment of the 1st respondent. Prior to his dismissal, the appellant was issued a query alleging misconduct in accordance with the provisions of the Management Manual of the 1st respondent. The Senior Staff Management Committee of the 1st respondent convened a hearing and found the appellant guilty of misconduct and summarily dismissed him. The appellant filed a suit at the Federal High Court Abuja challenging his dismissal and seeking orders of reinstatement and the sum of N1,000,000 (One Million Naira) as general damages for breach of his contract of employment. The appellant contended at the high court that the 1st respondent could not summarily dismiss him as his employment enjoyed statutory protection by virtue of the fact that being a public servant; he was also a civil servant. The high court dismissed the appellant’s claim. Dissatisfied with the decision, the appellant appealed to the Court of Appeal.
