Facts:

The appellants herein had obtained judgment against the respondents herein which had stated that the respondents as Defendants in the trial court shall pay the sum of N5,000.00 (Five thousand naira) and costs of N500 (Five hundred naira) as damages to the appellants as Plaintiffs. The respondents paid the total sum of N5,500.00 (Five thousand five hundred naira) awarded by the trial court to the appellants who objected on the ground that the amount awarded was N5,000,000.00 (Five million naira) as per the writ of summons. The appellants then proceeded to attach some of the respondent’s assets by virtue of a writ of execution issued by the same court. The respondent’s filed an application before the trial court to have the writ of attachment and execution set aside. The trial court granted the application and set aside the attachment and execution. The Court of Appeal dismissed the appeal and the appellants further appealed to the Supreme Court.
