Facts:

The plaintiff/applicant is a company registered in Nigeria. The 1st defendant is a cargo – a container of goods shipped into Nigeria which was nder arrest and placed in the custody of the Admiralty Marshall. The 2nd defendant is a company registered in Nigeria.

The plaintiff/applicant had applied to the Federal High Court Port Harcourt for the arrest and detention of the 1st defendant. The court granted the application and ordered the arrest on 19th July 2002. The 1st defendant remained in the custody of the Admiralty Marshall from that time. The plaintiff/applicant subsequently filed a motion on notice dated 7th May 2003 praying the court for the following:

1. An order pending the hearing and determination of this suit releasing to the plaintiff/applicant on bond or upon such other or further terms as this honourable court may deem fit cargo best described as 189 Cartons of Men’s Shirt and 3 cartons of Plastic and Paper Collar comprised in the container No. MOLU 2720957, 03986, 20’G.P. lying at Port Harcourt Sea Port for sale
