Facts:

The appellant, Okey Jim Nwagbara and the respondent, Jadcom Limited signed an agreement by which the appellant undertook to render quantity surveying consultancy service to the respondent. The agreement was with respect to a block of service flat at Wuse zone 1, phase 2 Abuja, for the preparation of the quotation and the contract sum analysis with the consideration of the sum of N433,969.00 (four hundred and thirty-three thousand, nine hundred and sixty-nine naira) only. On completion of the work by the appellant, the respondent refused to pay the agreed fee. Upon a threat to sue, which the appellant issued, the respondent referred him to a clause of arbitration in the said agreement and the matter thereafter went for arbitration. On the conclusion of the arbitration proceedings, an arbitral award was made in favour of the appellant and notice of same was served on the respondents through its solicitors, but again the respondent refused to pay.
