Facts:

The plaintiff filed an Originating Summons on the 21st of May, 2002, pursuant to the provisions of section 51 of the Arbitration and Conciliation Act (Cap. 19 LFN 1999) and Order 20 Rule 17 of the Federal High Court (Civil Procedure) Rules 2000; and under the inherent Jurisdiction of this Court seeking the following three reliefs, viz:

(i) An Order that Cargill International SA, the plaintiff herein, be at liberty to enforce in the same manner as a judgment or Order to the same effect, an award dated 23rd day of March, 2001, in the sum of US$253,532.46 plus 6.5% interest per annum from the date of award till payment is made of G.H. Toller, the Chairman of the panel of Arbitrators of the Refined Sugar Association of London, appointed by the plaintiff and the defendant herein in this matter;
