The claimant alleged that it entered into a contract with the defendant in which the latter was to transport 4,200 bags of NPK fertilizer from Lagos to Kano. The claimant further alleged that the defendant failed to deliver the 4,200 bags of fertilizer to the agreed destination. The claimant sued the defendant claiming among other reliefs, an order of the court directing the defendant to pay to it the sum of N29,068,000.00 (Twenty-Nine Million and Sixty Eight Thousand Naira).

The defendant counter-claimed and alleged that it never entered into any contract with the claimant to transport the fertilizer but merely introduced the claimant to the transporters whose drivers fraudulently diverted the said 4,200 bags of fertilizer. He further alleged that he took it upon himself to fund the prosecution of the suspects for which he was never reimbursed by the claimant.
