The claimant filed a suit against the defendants at the High Court of Lagos State
on the allegation that the sum of £21, 498.20 (Twenty One Thousand, Four Hundred
and Ninety Eight Pounds Sterling) was due to it being payment for accumulated
break-bulk and documentation charges made by the claimant to a certain company Merchant Express Limited, on behalf of the defendants. The claimant also claimed
2% pre-judgment interest on the said amount from August 2007.
The 1st defendant upon being served, raised a preliminary issue touching on the
jurisdiction of the court to hear the matter. The preliminary issue raised by the 1st
defendant was predicated on the allegation that the claimant was already dissolved
and not in existence at the time the action was filed. The 1st defendant also
incorporated a counter claim in which it alleged that the claimant induced some of
its workers to breach their employment with the 1st defendant/counter claimant
and depriving it of possession and use of its service equipment while retaining
same for the use and benefit of the of the claimant.
